Ruben  E. Socarras Founder / Member

Ruben E. Socarras, Esq. a founder and member of Marshall Socarras Grant, P.L., focuses his practice in the areas of complex commercial litigation, business law, employment law, and general civil litigation.  As an experienced litigator, Mr. Socarras often represents individuals and businesses in a variety of cases before state and federal courts, including those involving contract disputes, temporary/permanent injunctions, torts, trade secrets, unfair competition, intellectual property, fraud, breaches of fiduciary duty, employment related disputes, real estate and title claims, business dissolution, and shareholder/member disputes.   Mr. Socarras also represents his clients before arbitration panels and in mediations, among other types of alternative dispute resolution proceedings.   He regularly represents clients throughout the U.S. in a wide variety of industries, including those involved in internet law and affiliate marketing, technology, healthcare, staffing, insurance, private aviation, and real estate and development.  As a result, Mr. Socarras regularly handles complex commercial disputes, specifically advising clients on how to avoid litigation as well as managing it once it occurs.  In addition to litigation, Mr. Socarras serves as outside general counsel and advises clients in connection with their business transactional needs, which includes contract preparation and negotiations.

Mr. Socarras received his undergraduate degree from the University of Florida in 2000, and law degree from the Stetson University College of Law in 2003.  He is a member of the Florida Bar, South Palm Beach County Bar Association, and Broward County Bar Association. He is also admitted to practice in the United States District Court for the Southern and Middle Districts of Florida, and United States Bankruptcy Court in the Southern District of Florida. Mr. Socarras is rated AV Preeminent®, which is Martingale-Hubbell’s highest peer review rating based on a legal professional’s skills and ethics.  He was featured in the 2012 Edition of ALM South Florida’s Top Rated Lawyers, and selected to the Florida Super Lawyers list in 2015-2017, and 2010-2014 editions of Florida Super Lawyers in its Rising Stars list.  Recently, he was also selected as one of Florida Trend’s Florida Legal Elite Up and  Comer for 2016.  He also is a member of the Internet Law Leadership Summit (ILLS), which holds semi-annual meetings and is comprised of attorneys who practice in the areas of Internet law, intellectual property, and technology.

Mr. Socarras is a native of South Florida, is married and has two children. In addition to his active participation in the legal community, he currently serves as President and Board of Director of a non-profit organization benefiting children in the local community stricken with serious or terminal illnesses, and has been actively involved with the University of Florida Alumni Association.

Significant Representations

Secured $3.4 million award in hotly contested international contract action tried in California before a three-arbitrator panel of the American Arbitration Association and International Center for Dispute Resolution, arising from the failure to pay a contractual commission/fee for a transaction that yielded over $115 million in financing for the losing defendant/respondent.

Successfully defended and obtained summary judgment in lawsuit alleging fraud against client in real estate litigation involving $3.08 million, 18,000 sq. ft. home on a 153 acre estate in North-Central Florida.

Obtained defense verdict at trial for client being sued for several million dollars in real estate litigation alleging breach of contract and violation of Florida's Deceptive and Unfair Practices Act that involved the auction sale of two oceanfront homes in Golden Beach, Florida.

Successfully appealed and reversed dismissal of claims for injunctive relief after member in limited liability company was unilaterally expelled and member's interest was redistributed to other members. 40 Fla. L. Weekly D1246b; 2015 WL 3388387 (May 27, 2015)

Obtained defense verdict at trial in action seeking over $2,000,000 in proceedings supplementary that attempted to invade client's revocable living trust.

Successfully litigated and resolved out of state trade secrets litigation involving two national healthcare staffing firms.

Successfully defended and dismissed lawsuit filed against travel company and one of its top sales executive seeking damages and emergency injunction for alleged breach of employment agreement containing noncompetition and nonsolicititation clauses restricting competition for several years. Due to the dismissal, the Judge entered a judgment for legal fees/costs in favor of the defendants.

Obtained $1,670,000 Consent Final Judgment in catastrophic injury case arising from tractor-trailer trucking accident in Martin County, Florida.

Obtained defense verdict in software contract dispute by software provider against internet payment service provider (IPSP) that sought approximately $22,000,000 damages in American Arbitration Association proceeding.

Obtained favorable settlement for defendant contractor in insurance coverage dispute in federal court arising from a wrongful death action for carbon monoxide poisoning that occurred at large Key West, Florida hotel.

Effectively obtained dismissal of federal court action in large condominium unit dispute over developer's failure to close under purchase agreement.

Successfully obtained injunction against several defendants that stole client's confidential and proprietary client database following termination of several employees and business partner.

Representation of surgeon in federal court coverage action against disability insurer resulting in settlement of $250,000.00 after being wrongfully denied benefits under his disability insurance policy.

Secured over $3.6 million jury verdict in favor of injured construction worker in highly contested negligence action involving a stationary construction vehicle and moving commercial truck in Jupiter, Florida.

Counsel to bank as secured creditor in Chapter 11 case In re: Tramcon, Inc. in the U.S. Virgin Islands involving one of the Virgin Islands' notable and important tourist attractions.

Successful defense of affiliate marketing and digital advertising company in out of state federal lawsuit involving significant breach of contract related claims and counterclaims; resulting in confidential out-of-court settlement.
